This website is owned by Ripfox Technology (pty Ltd. Throughout the site, the terms “we”, “us”, “our” and "ripfox" refer to Ripfox Technology. Ripfox offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. SECTION 1 - ONLINE STORE TERMS

  3. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

  1. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, re-sellers or distributors.
  2. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall Ripfox Technology, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Ripfox Technology and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licencors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY

  1. In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION

  1. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
  2. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
  3. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT

  1. The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
  2. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
  3. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 18 - GOVERNING LAW

  1. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of South Africa.
  2. Country of domicile: This website is governed by the laws of South Africa and Ripfox Technology chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

  1. You can review the most current version of the Terms of Service at any time at this page.
    We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 20 - PAYMENT AND PAYMENT OPTIONS

  1. Payment for the goods and delivery charges can be made by any method shown on the Supplier´s website at the time you place your order. Payment shall be due before the delivery date and time for payment shall be a fundamental term of this agreement, breach of which shall entitle the Supplier to terminate the contract immediately.
    There will be no delivery until cleared funds are received.
    Payments shall be made by you without any deduction whatsoever unless you have a valid court order requiring an amount equal to such deduction to be paid by the Supplier to you.
  2. Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Ripfox Technology bank account, the details of which will be provided on request.
  3. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

SECTION 21 - DELIVERY OF GOODS

  1. The goods you order will be delivered to the address you give when you place your order, except that some deliveries are not made outside the South Africa.
    Orders placed before 3.00 pm on a working day will be processed that day and will be delivered as per the requested delivery option provided no additional security checks are required and all stock items are available. (A working day is any day other than weekends and bank or other public holidays.)
  2. If delivery cannot be made to your address for reasons under the Supplier´s control the Supplier will inform you as soon as possible.
    If you deliberately fail to take delivery of the goods (otherwise than by reason of circumstances under control of the Supplier) then without prejudice to any other right or remedy available to the Supplier , the Supplier may:
  3. Store the goods until actual delivery and charge you for reasonable costs (including insurance) of storage; or
  4. Sell the goods at the best readily obtainable price and (after deducting all reasonable storage and selling expenses) account to you for any excess over the price you agreed to pay for the goods or charge you for any shortfall below the price you agreed to pay for the goods.
    If you fail to take delivery because you have cancelled your contract under the Distance Selling Regulations the Supplier shall refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods. On exercising your right to cancel you shall be required to return the goods to the Supplier. Should you fail to return the goods, the Supplier reserves the right to deduct any direct costs incurred by the Supplier in retrieving the goods as a result of such failure.
  5. Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, the Supplier will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, the Supplier will inform you as soon as possible.
  6. Upon receipt of your order you will be asked to sign for the goods received in good condition. If the package does not appear to be in good condition then please refuse the delivery. If you are unable to check the contents of your delivery at the point of delivery then please sign for the parcel as "UNCHECKED". Failure to do so may affect any warranty claims that you make thereafter.
  7. AFTER PICK UP: Please do note once the courier picked up your parcel from us its out of our hands and we are not reliable for late deliveries. Please phone the courier company if you are worried about the delivery time or day.
    Ripfox assumes no liability for orders shipped to incomplete or incorrect shipping addresses supplied by the customer. Any additional fees for such orders will be the responsibility of the customer.
  8. Parcels will only be dispatched once payment reflects and has cleared in the bank account if paying by EFT or bank deposit.
    Ripfox cannot be held liable for missing or damaged parcel in transit, or any delays caused by the couriers or any 3rd party.

SECTION 22 - WARRANTY OF GOODS

  1. All goods supplied by the Supplier are warranted free from defects for Return to Base 1 Year from the date of invoice. This warranty does not affect your statutory rights as a consumer.
    Where goods are provided with a warranty period greater than 12 months, the first 12 months of the warranty covers all parts and labour costs, where as any subsequent period of the warranty cover only relates to labour costs only. e.g. If a product is sold with a 3 year warranty, the first 12 months covers parts and labour, and the next 24 months covers labour costs only.
    As stated above we provide Return to base warranty which means, Customers are liable for the shipping charges for returning of faulty goods. Shipping charges will not be refunded.
  2. This warranty does not apply to any defect in the goods arising from fair wear and tear, willful damage, accident, negligence by you or any third party, use otherwise than as recommended by the Supplier, failure to follow the Supplier´s instructions, or any alteration or repair carried out without the Supplier´s approval.
  3. If the goods supplied to you are damaged on delivery, you should notify the Supplier in writing via the Contact Us section of the website within 48 hours of delivery.
    If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify the Supplier in writing via the Contact Us section of the website, as soon as possible, but in any event within 3 days of the date you discovered or ought to have discovered the damage, defect or complaint. Failure to do so will mean that the said defect occurred at the time when it is actually reported to us.
  4. All LCD Monitors supplied by "Ripfox" come with no direct Warranty from "Ripfox". This warranty is provided by the manufacturer.Like all online computer suppliers "Ripfox" will not entertain any warranty issues regarding dead pixels. These issues must be dealt with directly with the manufacturer and the manufacturer’s decision will be final in all cases.
  5. All Promotional items (free goods e.g mouse/mouse pad/external drive/components etc.) do not carry any Warranty. "Ripfox" will not be held liable for any faults on these items, as they are provided as-is from the respective manufacturer.
  6. Any product that is sent in under warranty due to a fault, in the case that the same unit is no longer available / in-stock, a credit note will be passed for the value of the item sent in by the respected service agent to be used on a new purchase. The Service center credit is final and no negotiations will be accepted.

SECTION 23 - CARD ACQUIRING AND SECURITY

  1. Card transactions will be acquired for "Ripfox" via Ozow, Snapscan, ZeroPay and SID who are  approved payment gateway for all South African Acquiring Banks
  2. Ozow, Snapscan, ZeroPay and SID uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website (http://magento).
  3. Users may go to www.ozow.com , www.snapscan.co.za, https://zeropay.co.za  sidpayment.com to view their security certificate and security policy.

SECTION 24- CUSTOMER DETAILS SEPARATE FROM CARD DETAILS

  1. Customer details will be stored by "Ripfox" separately from card details which are entered by the client on Ozow secure site. For more information about Ozow. Snapscan, ZeroPay and SID refer to their websites.
